Terms of Service

These terms are an agreement between you and KP Digital Ventures Inc., a Canadian corporation (“we”, “us”), which owns and operates PlayTrendingGames (playtrendinggames.com) and its games (together, the “Service”). By using the Service you agree to these terms. If you do not agree, please do not use the Service.

1. Who can use the Service

The Service is intended for a general audience aged 13 and over. If you are under the age of majority where you live, please review these terms with a parent or guardian. Accounts, when they are available, are only for people aged 13 or over (or 16 or over where local law requires it).

2. Your licence to play

Our games are free to play. We give you a personal, non-commercial, non-transferable and revocable licence to use the Service for your own entertainment.

You agree not to:

• copy, sell, rent or redistribute our games, art, sounds, code or text;
• embed or reframe our games on another website or app without our written permission;
• reverse-engineer or tamper with the games or the site, except where the law allows it;
• use cheats, bots, scripts or exploits, or interfere with leaderboards or other players;
• scrape the site or overload it with automated requests;
• click on ads artificially, or encourage anyone else to (when ads are shown);
• use the Service for anything unlawful or harmful.

3. Accounts (coming soon)

Sign-in is optional. If you create an account, you agree to give accurate information, keep your sign-in details secure and let us know if you think your account has been misused. One account per person. You can delete your account at any time. We may suspend or close accounts that break these terms.

4. Names and other content you provide

If a game lets you choose a display name, it must not be offensive, misleading or infringe someone else’s rights. We may change or remove names that break these rules. You let us display the names and scores you choose within the Service.

5. In-game items and progress

Coins, upgrades, unlocks, scores and other in-game items have no real-world value. They cannot be exchanged for money, sold or transferred, and we may change or rebalance them to keep the games fun and fair. There is no gambling in our games and no way to win real money or prizes.

Progress saved only on your device can be lost if you clear your browser data. We are not responsible for lost progress, although we will always try to help.

6. Advertising

The Service may show third-party advertising in the future. Ads are the responsibility of the advertiser, and showing an ad does not mean we endorse the product. See our Privacy Policy and Cookie Policy for how advertising uses data.

7. Our intellectual property

The games, characters (including Pip, Kit, Professor Tock, Maple, Moose, Chef Miso and Juno), art, music, sound effects, code, text and the PlayTrendingGames name and logo are owned by KP Digital Ventures Inc. or used under licence. Third-party materials are credited on our Credits page. If you send us feedback or ideas, we may use them without any obligation to you.

8. Third-party links and services

The Service may link to other websites or use third-party services (such as sign-in with Google). We are not responsible for those websites or services, and their own terms apply.

9. Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we do not promise that it will always be available, error-free or that saved progress will never be lost. Please read our Disclaimer, including the health notice about flashing images.

10. Limitation of liability

To the extent permitted by law, KP Digital Ventures Inc. will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the Service. Because the Service is free, our total liability to you for any claim is limited to CAD $50.

Nothing in these terms limits any rights you have as a consumer that cannot be limited by contract, including under the consumer protection laws of Quebec, the European Union or the United Kingdom.

11. Indemnity

If you use the Service in a way that breaks these terms or the law and this leads to a claim against us, you agree to cover our reasonable costs, to the extent permitted by law.

12. Changes and termination

We may update these terms as the Service changes. We will change the “Last updated” date and, for significant changes, give notice on the site. We may stop offering any game or feature, or the Service as a whole. You may stop using the Service at any time.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Courts in that province will have jurisdiction, except where the law of the place you live gives you the right to bring a claim in your local courts.

14. General

If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with our Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Service.
